Eldorado Park child murder trial faces fresh delay as court seeks alternative judge

The search for a way forward in the murder case involving four-year-old “Baby Nikita” continued on Monday after the Johannesburg High Court postponed proceedings to determine whether another judge could take over the trial.

The case, which has drawn attention to allegations of severe abuse involving the Eldorado Park child, could not proceed as planned because another ongoing trial was given priority in the same courtroom.

Judge William Karam informed the court that a directive from the Acting Deputy Judge President required him to prioritise a part-heard trial involving four accused. That matter is expected to continue until 26 October, leaving the court unable to accommodate Baby Nikita’s trial during that period.

The matter was postponed to Tuesday to allow the state and court roll planners to investigate whether another judge would be available to hear the case.

Judge Karam explained that the parties had discussed the situation with legal counsel and agreed that further inquiries were necessary to establish whether the trial could proceed before another judge.

The latest setback follows earlier administrative challenges that prevented the trial from beginning as initially scheduled last week.

The case relates to the events of 6 August 2025, when police allegedly found the child unconscious with severe head injuries. She later died in hospital that month.

Her father faces charges including murder and rape, while her mother is accused of failing to report the alleged abuse. The father also faces an accusation of assaulting the couple’s three-year-old son.

Both parents remain in custody as arrangements for the trial continue.

The identities of the accused and the deceased child remain protected by a court order to safeguard the surviving sibling.

The case is expected to return to the Johannesburg High Court on Tuesday,13 October, when the parties will establish whether another judge can be made available to hear the matter.
